This case, brought under Article 41 of the Industrial Relations (Northern Ireland) Order 1992, in respect of the disclosure of information for collective bargaining purposes by Magherafelt District Council to NIPSA, was referred on 11 December 2009 to the Industrial Court. A hearing was arranged for 30 March 2010, at which the parties requested an adjournment pending the implementation of an agreement reached between the parties. NIPSA subsequently withdrew the application on 5 May 2010.

This was the first application made to the Court for assistance under paragraph 32 of Schedule 1A.
In 2004 the Court had issued a Declaration of Recognition in support of the Union to conduct Collective Bargaining and, subsequently, a method of bargaining had been agreed between the Union and the Employer.
The Union applied to the Court for assistance, as it was of the opinion that there had been a failure by the Employer to carry out the agreement. In the circumstances, the Panel decided to bring the Parties together informally to determine whether there was any scope for them to reach agreement on the contentious issues. After directions from the Panel, the parties entered into discussion and negotiation, which subsequently led to a mutually-agreed amendment to the Agreement.
